DALLAS - A judge has confirmed an arbitration award of more than $1.1 million in favor of a management services company in a breach of contract dispute with a doctors group. On March 31, 2016, Judge Bonnie Goldstein of Dallas County's 44th District Court entered a judgment confirming the award in favor of the management services provider against a local urology group. Lyons & Simmons, LLP partners Michael Lyons and Christopher Simmons tried the case resulting in the seven-figure award.
The urology group sued its management services provider in September 2014, claiming $2.3 million in damages for an alleged breach of their services agreement. The services provider denied the claim and filed a countersuit, asserting breach of contract and seeking attorneys' fees. Following nearly a year and a half of litigation, the arbitrator dismissed all of the urology group's claims and found that the group was in breach of contract. The arbitrator awarded damages, attorneys' fees, and pre- and post-judgment interest in favor of the management services provider.
